# Terms of Service
Effective Date: August 25, 2026
These Terms of Service govern your use of pawsandpromisecoffee.com and your purchase of products from Paws & Promise Coffee ("Paws & Promise Coffee," "we," "us," or "our"). By using our website or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the website or place an order.
## 1. About Paws & Promise Coffee
Paws & Promise Coffee is operated by Michael Rossi, doing business as (dba) Paws & Promise Coffee, with a business address at 50 Ledgeview Way, Apt 2420, Wrentham, MA 02093.
We sell freshly roasted coffee, specialty teas, single-serve coffee pods and capsules, and coffee-inspired apparel. Coffee products are fulfilled through Dripshipper, and merchandise products are fulfilled through Printful. We do not maintain or hold product inventory ourselves.
## 2. Eligibility and Account Use
You must be at least 18 years old, or the age of legal majority where you live, to place an order through our website.
You agree to provide accurate, current, and complete information when placing an order or creating an account. You are responsible for maintaining the confidentiality of your account information and for all activity under your account.
We may suspend or cancel an account if we reasonably believe it has been used fraudulently, unlawfully, or in violation of these Terms.
## 3. Product Descriptions and Availability
We make reasonable efforts to display product descriptions, ingredients, images, colors, sizes, roast profiles, and other product information accurately. However:
- Product colors and appearance may vary depending on your device or screen settings.
- Packaging, labels, and product details may change from time to time.
- Product descriptions are provided for general informational purposes.
- Product availability may change without notice.
- We do not guarantee that every product description, image, or other website content is complete, current, or error-free.
If a product is unavailable after you place an order, we may contact you to offer a substitute, delay fulfillment, or issue a refund for the unavailable product.
Please review product labels and ingredient information before consuming any coffee or tea. If you have allergies, dietary restrictions, or health concerns, consult the product packaging and an appropriate health professional before use.
## 4. Pricing, Taxes, and Payment
Prices are shown in U.S. dollars unless otherwise stated. Prices, product offerings, promotions, and discounts may change at any time.
The price charged for an order will generally be the price displayed when the order is submitted. We may correct pricing or other listing errors, including after an order has been placed. If a correction affects your order, we will provide an opportunity to cancel the order or receive a refund for the affected amount.
Applicable sales tax, shipping charges, and other fees will be displayed at checkout when required. You are responsible for all charges shown at checkout.
Payments are processed through third-party payment providers. By submitting payment information, you represent that you are authorized to use the payment method. We do not receive or store complete payment card information.
## 5. Orders and Order Acceptance
Submitting an order is an offer to purchase the selected products. An order confirmation means that we received your order; it does not necessarily mean that we have accepted it.
We may accept, decline, limit, or cancel an order for reasons including:
- Product availability;
- Pricing or listing errors;
- Payment problems;
- Suspected fraud or unauthorized activity;
- Shipping restrictions;
- An apparent violation of these Terms; or
- Other legitimate business reasons.
If we cancel an order after payment has been processed, we will generally refund the amount paid for the canceled portion of the order using the original payment method.
You may contact us promptly at support@pawsandpromisecoffee.com to request cancellation. Because coffee is roasted to order and orders may be sent quickly to fulfillment, we cannot guarantee that a cancellation request can be completed after processing or fulfillment has begun.
## 6. Roast-to-Order Coffee
Coffee products are generally roasted after an order is placed rather than stored as finished inventory. This process is intended to provide a fresher product.
Because coffee is roasted to order, we may be unable to accept returns or cancellations after roasting or fulfillment begins, except as required by law or as provided in our separate Returns and Refunds Policy.
Coffee may be offered as whole bean or freshly ground. Ground coffee cannot be returned solely because a customer selected the wrong grind option. Please review your selection carefully before completing an order.
## 7. Third-Party Fulfillment
We use third-party fulfillment providers, including Dripshipper for coffee products and Printful for merchandise. These providers may receive the information necessary to produce, package, and ship your order.
We remain responsible for processing your customer order, but fulfillment timing, packaging, shipping carrier selection, and certain production details may be handled by the applicable provider.
Separate terms, policies, and procedures of those providers may apply to their services. However, your purchase from Paws & Promise Coffee remains governed by these Terms and any applicable policies posted on our website.
## 8. Shipping and Delivery
We currently ship to locations identified as available at checkout. Shipping options, estimated delivery times, and shipping charges will be shown during checkout when available.
Shipping and delivery dates are estimates, not guarantees. Delays may occur because of weather, carrier issues, customs, production times, incorrect addresses, holidays, or events outside our reasonable control.
You are responsible for providing a complete and accurate shipping address. We may charge additional shipping costs for address corrections, reshipments, or failed deliveries caused by an incorrect or incomplete address.
Unless otherwise required by law, responsibility for products may pass to you upon delivery to the shipping address provided at checkout. If your package appears damaged, is missing, or is marked delivered but cannot be located, contact us promptly at support@pawsandpromisecoffee.com so we can help investigate.
Orders containing products fulfilled by different providers may arrive in separate shipments and at different times.
## 9. Returns, Refunds, and Exchanges
Returns, refunds, replacements, and exchanges are governed by our separate Returns and Refunds Policy, available at https://pawsandpromisecoffee.com/returns-refunds-policy.
Please review that policy before placing an order. Nothing in these Terms limits any non-waivable rights you may have under applicable law.
If you receive an incorrect, damaged, defective, or materially different product, contact us at support@pawsandpromisecoffee.com within the period stated in the Returns and Refunds Policy, with your order number and photographs or other relevant details when available.
## 10. Giveback and Donation Program
Paws & Promise Coffee is a for-profit business. A purchase from us is not itself a charitable donation, and customers should not treat the purchase price or any portion of it as a tax-deductible contribution.
Our current giveback commitment is that 10% of eligible sales will be donated in equal shares: 5% to Forever Paws Animal Shelter and 5% to Sweet Inspirations Candy Store, a nonprofit candy store and supportive employment job site sponsored by the Aaron Zenus Foundation.
For purposes of this commitment, "eligible sales" means product revenue actually received by Paws & Promise Coffee, excluding sales taxes, shipping charges, discounts, canceled orders, refunded orders, chargebacks, and other amounts not retained by us, unless a particular promotion states different terms.
Donations are made by Paws & Promise Coffee and are not collected separately from customers. We may make donations periodically and may publish general information about donations made. We will not represent that a specific purchase was directed to a particular individual, animal, program, or expense unless we expressly state otherwise.
Forever Paws Animal Shelter, Sweet Inspirations Candy Store, and the Aaron Zenus Foundation are independent organizations. Unless we expressly state otherwise, they do not operate our website, fulfill orders, provide customer service, or guarantee our products and services.
The giveback program is subject to applicable law and any required charitable-solicitation disclosures, agreements, registrations, reports, or other filings. We may modify or discontinue the program when reasonably necessary, including to comply with legal requirements. Any change will not affect donations already earned under previously published terms.
## 11. Intellectual Property
The website and its contents, including text, product descriptions, graphics, logos, photographs, designs, page layouts, videos, and other materials, are owned by or licensed to Paws & Promise Coffee and are protected by applicable intellectual-property laws.
We grant you a limited, personal, nonexclusive, nontransferable, and revocable right to access and use the website for personal, noncommercial purposes and to purchase products from us.
You may not copy, reproduce, modify, distribute, sell, publish, transmit, create derivative works from, or exploit website content without our prior written permission. You may not use our name, logos, trademarks, or other brand features in a way that suggests an unauthorized affiliation or endorsement.
## 12. Customer Content
If you submit a review, photograph, comment, testimonial, suggestion, or other content to us or through the website ("Customer Content"), you represent that you have the right to submit it and that it does not violate another person's rights or applicable law.
You grant Paws & Promise Coffee a worldwide, nonexclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, display, distribute, and otherwise use Customer Content for business, marketing, and promotional purposes, subject to applicable law.
You should not submit confidential, sensitive, or personal information that you do not want us to use in accordance with this license.
We may remove Customer Content that we believe is unlawful, misleading, offensive, infringing, or inconsistent with these Terms. We do not necessarily endorse opinions expressed in Customer Content.
## 13. Prohibited Uses
You may use the website only for lawful purposes. You may not:
- Violate any applicable law or regulation;
- Use the website to commit fraud or facilitate unauthorized transactions;
- Interfere with the operation, security, or availability of the website;
- Attempt to gain unauthorized access to accounts, systems, or data;
- Introduce viruses, malware, or other harmful code;
- Scrape, harvest, or collect information from the website without permission;
- Use automated systems to place orders or access the website in a way that imposes an unreasonable burden;
- Impersonate another person or misrepresent your relationship with Paws & Promise Coffee or any other organization;

To the fullest extent permitted by law, Paws & Promise Coffee and its owners, officers, employees, contractors, service providers, suppliers, and fulfillment partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to:
- Your use of or inability to use the website;
- Your purchase, use, or inability to use a product;
- Shipping delays, delivery problems, or carrier conduct;
- Third-party websites, payment processors, or fulfillment providers;
- Unauthorized access to information; or
- Any other matter related to the website or your order.
To the fullest extent permitted by law, our total liability for any claim related to the website or an order will not exceed the amount you paid to Paws & Promise Coffee for the product or service giving rise to the claim.
These limitations do not apply to liability that cannot legally be limited or excluded, including liability for fraud, willful misconduct, or other liability that applicable law prohibits us from limiting.
## 17. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Paws & Promise Coffee and its owners, officers, employees, contractors, service providers, suppliers, and fulfillment partners from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from or related to:
- Your violation of these Terms;
- Your misuse of the website or products;
- Your Customer Content;
- Your violation of another person's rights; or
- Your violation of applicable law.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification. You agree to cooperate with that defense.
## 18. Governing Law and Venue
These Terms and any dispute arising from or related to them will be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.
Any legal action that is not required to be brought elsewhere by applicable law will be brought in the state or federal courts located in Norfolk County, Massachusetts, and you consent to the jurisdiction and venue of those courts.
## 19. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this website with a revised Effective Date.
Changes will apply prospectively unless applicable law requires otherwise. Your continued use of the website or placement of an order after updated Terms are posted means that you accept the updated Terms.
## 20. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in effect.
## 21. Entire Agreement
These Terms, together with any policies or additional terms expressly referenced here, constitute the entire agreement between you and Paws & Promise Coffee concerning your use of the website and purchase of products.
If these Terms conflict with a separate policy, the separate policy will control only for the subject matter covered by that policy.
